HELIXSTRAT TERMS OF SERVICE

These Terms of Service govern your access to and use of HelixStrat.com, the HelixStrat website, products, services, member resources, TradingView scripts, indicators, strategies, guides, downloads, and related content.

Throughout these Terms, the words "HelixStrat," "we," "us," and "our" refer to HelixStrat, doing business as HelixStrat. The words "you" and "your" refer to any visitor, customer, subscriber, member, or user of our website, products, services, or content.

By accessing HelixStrat.com, purchasing a subscription, creating an account, submitting your TradingView username, accessing member resources, or using any HelixStrat script, guide, download, or service, you agree to be bound by these Terms of Service and our related policies, including our Privacy Policy, Refund Policy, Risk Disclosure, and any other policies posted on the website.

If you do not agree to these Terms, you may not access or use HelixStrat.com, purchase a subscription, or use any HelixStrat products or services.


1. OVERVIEW OF SERVICES

HelixStrat provides TradingView-based decision-support tools, educational content, strategy resources, and member materials designed to help users evaluate market context, chart structure, technical indicators, backtesting information, and trading workflows.

The primary HelixStrat subscription currently includes access to:

  • Helix MTF Indicator

  • Helix Adaptive Strategy

  • Setup guides

  • Quick reference guides

  • Member resources

  • Updates made available while subscribed

  • TradingView invite-only script access while the subscription remains active

HelixStrat tools are designed for education, research, backtesting, and decision support only. They are not designed to provide financial advice, investment advice, trade recommendations, or guaranteed trading results.


2. ELIGIBILITY AND ACCOUNT RESPONSIBILITY

By using HelixStrat, you confirm that you are at least the age of majority in your jurisdiction and that you have the legal authority to enter into these Terms.

You are responsible for:

  • Providing accurate registration, billing, and contact information.

  • Providing your exact TradingView username when required.

  • Keeping your account login information secure.

  • Ensuring that any person accessing HelixStrat through your account complies with these Terms.

  • Notifying us promptly if you believe your account, password, billing information, or TradingView access has been compromised.

You may not use HelixStrat for any unlawful purpose or in violation of any applicable law, regulation, exchange rule, brokerage rule, platform rule, or third-party terms.


3. SUBSCRIPTION ACCESS

HelixStrat Access is a paid subscription that provides access to both the Helix MTF Indicator and Helix Adaptive Strategy through TradingView invite-only script access.

The current subscription options are:

  • $60 per month, billed monthly

  • $480 per year, billed annually upfront, equivalent to $40 per month

Pricing may change in the future. Any pricing changes will apply according to the billing terms provided at checkout or as otherwise communicated to active subscribers.

A subscription does not give you ownership of any HelixStrat script, source code, system, indicator, strategy, documentation, brand asset, design, or intellectual property. A subscription only gives you limited access to use the available HelixStrat tools and resources while your subscription remains active and in good standing.


4. TRADINGVIEW INVITE-ONLY ACCESS

HelixStrat scripts are delivered through TradingView invite-only access.

To activate access, you must provide your exact TradingView username. You are responsible for ensuring that the username is accurate, complete, and current.

Access is manually reviewed and typically activated within 24 hours after successful subscription and receipt of the correct TradingView username. We do not guarantee instant access.

If you provide an incorrect TradingView username, access may be delayed. If your TradingView username changes, you must notify us so access can be updated.

Your TradingView access is limited to the username associated with your active subscription. You may not share, resell, transfer, sublicense, or provide your HelixStrat access to another person.

If your subscription is canceled, refunded, charged back, unpaid, expired, or otherwise not in good standing, we may remove your TradingView access to all HelixStrat scripts.


5. REFUND POLICY

HelixStrat subscriptions provide immediate access to digital TradingView tools, invite-only script access, member resources, and related materials. Because access is digital and may be granted shortly after purchase, payments are generally non-refundable once access has been provided.

If you believe HelixStrat is not the right fit, you may contact support@helixstrat.com within 7 calendar days of your initial purchase to request a refund review.

Refund requests are reviewed on a case-by-case basis and are not guaranteed. Approval or denial of a refund request is determined at HelixStrat’s discretion unless otherwise required by applicable law.

If a refund is approved:

  • Your payment may be refunded through the original payment method when possible.

  • Your TradingView invite-only access will be removed.

  • Your member access may be removed.

  • Your subscription may be canceled.

Renewal payments, recurring subscription charges, annual renewal payments, partially used billing periods, promotional purchases, discounted purchases and payments made after the initial 7-day review period are not refundable unless required by applicable law.

Accounts that violate these Terms of Service, misuse HelixStrat access, share invite-only access, dispute valid charges, or attempt to copy, resell, redistribute, or reverse engineer HelixStrat materials may be denied a refund.

If a refund is requested due to a billing error, duplicate charge, or other special circumstance, HelixStrat may determine the appropriate resolution on a case-by-case basis.


6. CANCELLATION

You may cancel your subscription according to the cancellation process available through the website, payment platform, or customer account portal.

If you cancel without requesting or receiving a refund, your access may remain active until the end of the paid billing period. After the paid billing period ends, your member access may be removed.

If your payment fails, is disputed, is charged back, or cannot be processed, we may suspend or remove access until the account is brought current.

You are responsible for canceling before your next billing date if you do not want to renew.


7. EDUCATIONAL AND INFORMATIONAL PURPOSES ONLY

HelixStrat tools, indicators, strategies, dashboards, scores, labels, alerts, guides, examples, screenshots, videos, backtests, and website content are provided for education, research, backtesting, and decision support only.

Nothing on HelixStrat.com or within any HelixStrat product should be interpreted as:

  • Financial advice

  • Investment advice

  • Trading advice

  • Legal advice

  • Tax advice

  • Accounting advice

  • A recommendation to buy, sell, hold, short, or trade any security, option, futures contract, cryptocurrency, commodity, currency, index, exchange-traded fund, or other financial instrument

  • A guarantee of profit

  • A guarantee of loss prevention

  • A personalized recommendation

You are solely responsible for your own trading decisions, investment decisions, risk management, account management, order placement, position sizing, and use of HelixStrat tools.

You should consult a qualified financial professional before making financial or investment decisions.


8. TRADING RISK DISCLOSURE

Trading and investing involve substantial risk. Many traders and investors lose money.

You should carefully consider whether trading or investing is suitable for you based on your financial condition, experience, objectives, and risk tolerance.

HelixStrat does not guarantee that you will make money, avoid losses, improve performance, or achieve any particular result.

Past performance does not guarantee future results. Market conditions change, and strategies that performed well historically may perform poorly in the future.

You agree that you use HelixStrat tools at your own risk.


9. BACKTESTING, HYPOTHETICAL PERFORMANCE, AND SIMULATED RESULTS

Any backtest, chart example, strategy output, screenshot, performance table, quality grade, net profit display, win rate, profit factor, expectancy, drawdown figure, signal label, or historical example shown by HelixStrat is hypothetical, simulated, educational, and illustrative.

Hypothetical and simulated results have important limitations. They do not represent actual trading. They may be created with the benefit of hindsight. They may not account for real-world market conditions, broker execution, liquidity, spreads, slippage, commissions, data quality, platform behavior, order routing, partial fills, emotional decision-making, or other factors that can affect live trading.

No representation is being made that any account will or is likely to achieve profits or losses similar to any example, screenshot, backtest, strategy table, or historical result shown.

Live trading results can differ materially from backtested or simulated results.

You should paper trade, forward test, and independently validate any strategy, indicator, signal, alert, or workflow before risking live capital.


10. ALERTS, SIGNALS, AND AUTOMATION

HelixStrat may include alerts, signal labels, strategy logic, dashboards, decision-support scores, or other outputs that users may interpret or use as part of their trading process.

Any alerts, labels, signals, scores, tables, or automated outputs are provided for informational, educational, research, and decision-support purposes only.

HelixStrat does not execute trades for you. HelixStrat does not monitor your brokerage account. HelixStrat does not place, modify, cancel, or manage trades in your account.

You are solely responsible for any action you take based on alerts, signals, labels, webhooks, strategy outputs, chart data, dashboard values, or any other HelixStrat content.

Alert delivery is not guaranteed. Alerts may be delayed, missed, duplicated, interrupted, or affected by TradingView, internet connectivity, user settings, third-party platforms, or other technical conditions outside our control.


11. TRADINGVIEW DISCLOSURE

HelixStrat tools are designed for use with TradingView.

TradingView is a registered trademark of TradingView, Inc. TradingView has no affiliation with HelixStrat and does not sponsor, endorse, own, operate, manage, approve, or control HelixStrat products or services.

You are responsible for maintaining your own TradingView account and complying with TradingView's terms, plans, feature limits, and platform rules.

TradingView plan limitations may affect how many indicators, strategies, alerts, charts, or layouts you can use. HelixStrat is not responsible for TradingView account restrictions, TradingView service interruptions, TradingView feature changes, TradingView data behavior, or TradingView platform limitations.


12. MARKET DATA AND PLATFORM DIFFERENCES

Market data, chart calculations, strategy results, indicator outputs, alerts, and backtests may differ across platforms, brokers, exchanges, data providers, timeframes, sessions, asset classes, and user settings.

Differences may occur due to:

  • Data vendors

  • Time zones

  • Session settings

  • Extended hours settings

  • Corporate actions

  • Rounding

  • Liquidity

  • Slippage

  • Spreads

  • Commissions

  • Intrabar movement

  • Backtesting assumptions

  • Order execution models

  • Broker behavior

  • TradingView settings

  • Script settings

  • User-selected inputs

You are responsible for independently verifying any data, calculations, levels, outputs, or strategy results before relying on them.


13. INTELLECTUAL PROPERTY

All HelixStrat content and services are owned by HelixStrat or its licensors and are protected by copyright, trademark, trade secret, and other intellectual property laws.

This includes, but is not limited to:

  • Pine Script code

  • TradingView scripts

  • Indicators

  • Strategies

  • Algorithms

  • Signal logic

  • Strategy logic

  • Dashboard designs

  • Tables

  • Scores

  • Labels

  • Website content

  • Text

  • Graphics

  • Images

  • Videos

  • Guides

  • Downloads

  • Training materials

  • Branding

  • Logos

  • Product names

  • Layouts

  • Design elements

  • Documentation

You receive a limited, revocable, non-exclusive, non-transferable license to access and use HelixStrat products for your personal or internal trading research purposes while your subscription remains active.

You may not:

  • Copy, reproduce, resell, redistribute, sublicense, lease, share, publish, or transfer HelixStrat products or content.

  • Reverse engineer, decompile, decode, disassemble, recreate, imitate, or attempt to discover the source code, logic, formulas, algorithms, or internal operation of HelixStrat scripts.

  • Modify, adapt, translate, clone, or create derivative works based on HelixStrat products.

  • Share screenshots, guides, private resources, scripts, members-only materials, or access credentials in a way that violates these Terms.

  • Use HelixStrat branding, logos, product names, website content, or materials without written permission.

  • Use HelixStrat products to create a competing product or service.

Violation of this section may result in immediate termination of access without refund.


14. USER CONTENT AND FEEDBACK

If you submit feedback, ideas, suggestions, questions, testimonials, comments, support messages, bug reports, feature requests, chart screenshots, strategy observations, or other content to HelixStrat, you grant HelixStrat permission to use that information to improve, support, market, or operate the service, unless otherwise agreed in writing.

You are responsible for ensuring that any content you submit does not violate any law, third-party right, confidentiality obligation, platform rule, or intellectual property right.

Do not submit confidential, proprietary, restricted, or third-party protected material unless you have the right to do so.


15. TESTIMONIALS AND USER RESULTS

Testimonials, user comments, reviews, screenshots, examples, or shared results are not guarantees of future performance and may not be typical.

HelixStrat does not have access to customers' brokerage statements or complete trading records unless voluntarily provided. We do not independently verify all user claims, testimonials, screenshots, or trading results.

Your results may differ significantly from any example, testimonial, screenshot, or statement shown on the website or in marketing materials.


16. PROHIBITED USES

You agree not to use HelixStrat, the website, scripts, services, or content:

  • For any unlawful purpose.

  • To violate any applicable law, regulation, platform rule, exchange rule, or third-party right.

  • To infringe or misappropriate intellectual property rights.

  • To copy, clone, imitate, reverse engineer, or redistribute HelixStrat products or services.

  • To share, sell, lease, transfer, or sublicense your access.

  • To attempt to bypass payment, access controls, invite-only permissions, account restrictions, or security measures.

  • To upload or transmit malicious code, viruses, worms, or harmful software.

  • To scrape, crawl, harvest, collect, or misuse data from the website or services.

  • To impersonate another person or misrepresent your identity.

  • To interfere with the operation, security, or availability of the website or services.

  • To harass, abuse, threaten, defame, or harm others.

We may suspend or terminate access for any violation of these Terms.

We may update, modify, improve, remove, replace, suspend, or discontinue any part of HelixStrat at any time.

This may include changes to:

  • Features

  • Settings

  • Dashboards

  • Tables

  • Labels

  • Scores

  • Presets

  • Documentation

  • Member resources

  • Pricing

  • Access process

  • Supported platforms

  • Website content

  • Subscription structure

We do not guarantee that any feature, script, setting, guide, output, or service will remain available forever.

We are not liable if the website, scripts, TradingView access, member resources, downloads, guides, or services are unavailable at any time or for any period.


18. THIRD-PARTY SERVICES

HelixStrat may rely on third-party platforms and services, including TradingView, Squarespace, Stripe, payment processors, email platforms, analytics tools, hosting providers, and other service providers.

We are not responsible for the availability, accuracy, security, policies, pricing, functionality, outages, changes, or actions of third-party services.

Your use of third-party services may be governed by their own terms and privacy policies.


19. DISCLAIMER OF WARRANTIES

HelixStrat products, website, scripts, guides, downloads, resources, and services are provided on an "as is" and "as available" basis.

To the fullest extent permitted by law, HelixStrat makes no warranties, representations, or guarantees of any kind, whether express or implied, including but not limited to:

  • Accuracy

  • Reliability

  • Profitability

  • Suitability

  • Availability

  • Completeness

  • Timeliness

  • Fitness for a particular purpose

  • Non-infringement

  • Merchantability

  • Error-free operation

  • Uninterrupted access

  • Compatibility with any platform, broker, device, or TradingView plan

We do not guarantee that HelixStrat will meet your expectations, improve your trading results, prevent losses, or produce any specific result.


20. LIMITATION OF LIABILITY

To the fullest extent permitted by law, HelixStrat and its owners, officers, contractors, affiliates, agents, service providers, and partners will not be liable for any direct, indirect, incidental, consequential, special, punitive, or exemplary damages arising from or related to your use of or inability to use HelixStrat.

This includes, but is not limited to:

  • Trading losses

  • Investment losses

  • Missed trades

  • Missed profits

  • Lost opportunities

  • Data errors

  • Delayed alerts

  • Failed alerts

  • Platform outages

  • Payment issues

  • Access delays

  • TradingView issues

  • Broker issues

  • Market data issues

  • User input errors

  • Strategy or indicator performance

  • Reliance on any chart, signal, score, table, label, guide, screenshot, backtest, or example

Your use of HelixStrat is at your own risk.


21. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless HelixStrat, its owners, officers, contractors, affiliates, agents, partners, licensors, service providers, and employees from and against any claims, demands, damages, liabilities, losses, costs, or expenses, including reasonable attorneys' fees, arising from or related to:

  • Your use of HelixStrat.

  • Your trading or investment decisions.

  • Your breach of these Terms.

  • Your violation of any law, regulation, platform rule, or third-party right.

  • Your misuse of HelixStrat products or services.

  • Your submission of inaccurate, unlawful, or infringing content.

  • Your sharing, copying, resale, reverse engineering, or unauthorized use of HelixStrat materials.

22. TERMINATION

We may suspend, restrict, or terminate your access to HelixStrat at any time if we believe you have violated these Terms, failed to pay, disputed a charge, provided false information, shared access, attempted to copy or imitate the service, or misused the website, scripts, or materials.

Termination may include:

  • Removal of TradingView invite-only access.

  • Cancellation of member access.

  • Removal from email lists or member resources.

  • Denial of future service.

  • Refusal of refund when termination results from a violation of these Terms.

Sections related to intellectual property, disclaimers, limitation of liability, indemnification, prohibited use, and dispute handling survive termination.


23. CHANGES TO THESE TERMS
